first apply for a passport at the consulate/embassy of your citizenship. then get your marriage certificate ready. go to a lawyer and present your case.
it is possible that you will be required by the uscis (US citizenship and immigration services)/nvc (national visa center) to return to your home country while your case is being processed, specially now that you are out of status. in any case, there's a good chance that you can get a green card, as long as your husband's green card is valid.

If you visa and passport are expired and you have overstay you visit in the U.S. I do not believed that the U.S. Department of state would give you another visa. If you husband is a U.S Citizen or a Legal Permanent Resident then he needs to petition for you by filing a I-130 form, petition for an alien relative.
