Filing for Fiance Visa for my filipino gf, does US check her marriage status with NSO or somewhere else?
I've been to the NSO site and I can request a copy of my fiance's Certificate of No Marriage (CENOMAR) record, and even a copy of her marriage certificate if she had one. I will use those documents in my application, I just want to make sure I am getting it from a viable source.
Answer:
They will check both.
If she has children, or if the physical exam show signs of unreported child birth, it's possible they'll send a trained Filipino investigator to where she grew up and any other places she's lived. There they'll check the local town hall records, police records, church records and talk to the Barangay Captian, family members, neighbors, teachers, friends and anyone else they can find who knows her. This will delay the process by several months.
Most Filipinos have a very casual attitude toward things like "paper work." She needs to know, under no uncertain terms, that she's not to submit any fake papers (it's easily purchased in Manila) and she must not lie. If she doesn't know the answer to a question a simple, "I don't know" will do just fine. Don't make it up.
I'm obviously not familiar with Filipino Government Agencies, but I would also obtain background clearances from the Police/Bureau of Investigation or what ever their equivalent agency to the US Department of Justice.
