Fiance visa?
I am an Iranian national and have been refuesed asylum. I am still living in the UK and engaged. My fiance is German and living in the UK with me. I would like to return to Iran and apply for a fiance visa as we can not marry here like this. Will there be any problems because I was refuesed asylum? How long will it take to get out of Iran again? Will there be problems when leaving the UK? Thanks for your replies
Answer:
All visa applications are resolved on their individual merit. It is quite impossible to say whether you will nor will not get the visa, nor how long it will take. The asylum application is not a bar in itself but will have be be declared to the visa officer.
Incidentally - my office recently assisted another Iranian with his repatriation, communicating his UK status and situation to the ECO in Tehran so that they would progress his visa application with a minimum of difficulty. We did the same for a Tanzanian who made contact via this site.
If you wish my (London based) office to assist with your repatriation then drop me an email. We can liaise with the airport to make sure that everything is done to ensure you make your flight.
Additional: That's fine advice from Jim. Marriage in Germany and an EEA permit is quite possibly the only realistic way forward. This would remove the British Embassy from the equation, but my office would still be able to assist with your departure. We could also update local records to show what has happened and why - so that the British Embassy you apply to for an EEA permit would have the updated facts available.
Re the third answer here: No checks at Heathrow? Wrong. And even if you do slip past our records will still show you are in the UK. Sneaking out would NOT be clever if you intend to return.
There would be no problem returning to Iran. Your best option would be to contact IOM - http://www.iomlondon.org/ - who can assist you to return. I'm not sure exactly about the visa arrangements for coming to marry an EU national in the UK; if it was a British citizen, you would apply for a fiance visa, and your partner would have to show that they could support and accommodate you without needing public funds. Given your immigration history, where the Home Office have rightly or wrongly concluded that your claim for asylum was false, any application you made would be looked at very carefully indeed. Obviously, your return to Iran would be taken as evidence that your asylum claim was indeed false.
It might be easier for you to apply from Iran for a visa to go to Germany and get married there. You would have to explain to the German authorities how you met your partner while living in the UK, but I doubt if they would look into your whole case history in the UK. Once legally married, you would have the right to accompany your EU-citizen spouse to the UK, you would need to apply for an EEA family permit. You would be allowed to work, and everything should be OK.
You need to think very carefully about this, and get good quality professional advice. Your fiance should look into the details about visas for Germany. A few sites that might help:

Hi Yaghob,
Go to Iranian embassy in london, take your iranian national ID card and your home office ind card and apply for your iranian passport, there would be no problem or any questions. then purchase tickets and go back to iran, there are no checks or what so ever in uk heathrow so do not panic, once you get to iran you'll go through the gates passport check and into the country without questioning or what so ever, but you'll have to revalidate your passport to be able to travel again which basicaly takes 24 hours, then go to german embassy and apply for your fiance visa, don't forget that you need enough evidence to prove that you intend to marry your fiance or going to live together and have enough funds to support your expenses without relying on public funds in germany. What I suggest you is take your fiance to iran and live there as she might like it there.
We are just in the process of stopping the ,massive flood of immigrants into the UK. We have taken 1000 years to build the UK and we are now full. Illegal immigrants will all be deported
