Could the decision of the USCIS be delayed on an expired 2 years temporary G.Card, untill the divorce is made?
Answer:
Your question is very confusing....
I have heard of a few instances where USCIS will take forever to make a decision, but USCIS will usually extend the Green Card expiration date every year until a decision is made.
If you have a conditional Green Card, then you must file for the removal of condition 90 days before GC expires. If the couple is still legally married 90 days before expiration, the couple MUST JOINTLY FILE. This means that, even if a divorce is pending, both people must sign the removal request.
If the couple divorce prior to the GC expires, then the Green Card holder can file to remove the conditions by him/herself, but will need to provide strong evidence that the marriage was not a sham.
If a GC holder fails to file for the removal of conditions before expiration, or very, very shortly after, then I believe the Green Card will become void with no possibility to renew.
