Mortgage recident perment visa?

I have recident permit visa ,i will apply next year for UK citizenship but we want to buy house with my british husband as a mortgage.Lenders dont let to me for apply a mortgage.my husband can apply. i am little bit upset this matter.i am not sure,if he buy this mortgage his name can he sale this house without me.if i have lost that house can i get council house myself with my baby.i am asking bec i am so confused.if divorce one day how much i have right.bec i am working and i will help to house.i dont want one day lost.if somebody knows please answer

Most couples put their properties in joint names, regardless of who pays the mortgage. Also, the mortgage lender will take your earnings into account and most likely ask for your name to go on the mortgage agreement as well.

Even if the house was only in your husband's name, if there was a divorce the court would decide what was the fairest way to divide up the assets, they will take into consideration the money you have put in as wel as the unpaid housework that helped your husband to work.

Usually, the one who looks after the child will stay in the house. If the house is in the husband's name, but your relationship is breaking down and you think he might try to sell the house before the court can make a decision, you would need to go to a Citizens Advice Bureau or solicitor to help you to register your interest in the house; he would then not be able to sell the house before the court made a ruling.

Even if you lost the house, the child would have to be housed, with the parent who was looking after the child; so most likely you would get council housing; however, it would probably be much easier for you if you could stay in your own house.

I am sorry that you have doubts about trusting your husband. As you already have Indefinite Leave to Remain, you have full rights here, and nothing to worry about in terms of your rights. You will probably have had some negative comments, ignore them.

Also, there is no reason for a lender to refuse your application just because of your citizenship; maybe your earnings aren't enough?

You don't have to be a British Citizen to get a mortgage, ILR is more than enough for any lender. You may want to try going through an Independent Financial Adviser (IFA), they would find a suitable mortgage for you and handle the paperwork. If you have a baby you won't lose the house, and you won't end up on the street.

If the mortgage is in your husband's name only, do register you interest in the property (a solicitor can do it confidentially for a small charge). Besides if you go for a joint mortgage and cannot pay it, you and your husband would be equally liable - which means you may go bankrupt together. You application for British Citizenship might be refused in that case, as you have to pass a good character test.
