What would happen if i found someone to be illegal..just in passing, can i arrest them?
Answer:
Yes. You should immediately place a citizens arrest the
moment you realize a person is illegal or you suspect that
he or she might be illegal. First you should learn how to give
the miranda rights and keep the numbers to your local police
and homeland security(border patrol) on hand. It may help
to keep large tie-ties with you if for some reason one of the
detainees does not intend to comply. With more people like
you and I around our country wouldn't be having debates
about illegal imigrants.
Yes, but most likely you would get in trouble since there are so many politicians who tell police departments what to do.
A U.S. citizen in Arizona was arrested for stopping illegal aliens that he caught trespassing on his land. He was arrested by the local police.
No. Better call the police and let them handle.
you could, but it would get you in trouble and use energy
First, you must be 100% positive that the individual is illegal and undocumented before you do any kind of arrest. Second, I would just call the authorities or BP agents about what you know and let them handle the situation. And lastly, thank you for being a good citizen and for even taking time to give attention on this big issue that our coutry has been dealing with for the past decades. We all deserve to be in U.S. but we all MUST have legal documents and papers to work and stay in America.
Legally, you can not arrest somebody for being illegal, being illegal is not a crime, and you can get in serious trouble for violating another person's civil rights, remember that the u. s. constitution applies to anyone whithin the us territory, even if its an illegal, they also enjoy of all of the ammendments of the constitution.
Now, you CAN legally place somebody in citizen's arrest, as long as they are trepassing into YOUR land, not into your neighbors or your moms, but yours and only yours, then you can call the police and the person can be tried or deported.
Well, you could, if you have hours to waste. I know our city has a stupid policy about only deporting them to ICE if they have a criminal history. Excuse me, but isn't it illegal to be an illegal alien?
Apparently not to our council.
Listen, I live in El paso, which is connected of Juarez, Mexico. If the Border Patroll does not arrest them, why should you?
no why would you want to?
No, you legally cannot. It is current federal policy to not deport illegal immigrants unless they have committed certain crimes (murder, drug offenses, etc.). If you "arrest" someone and hand them over to ICE, they will run a background check, find out that the person hasn't committed any crimes since coming here, and release them.
