How can i get a wavier of deportation from INS and get rid of 10 years no entry retraint?
but have been dumped away from my family because of paper work, my attorney told me that tehey will never ever let me in again
Answer:
What he is actually saying is that he either went to the immigration court, or perhaps didn't show up, and was deported in absentia.
That is what he means by "order to go away from the Us". It's a voluntary departure that was converted into an actual deportation.
Before we pounce on him in judgment (as is the MyTend fashion), we would need to know much more about why he was sent to the immigration court in the first place.
So, why did you take a voluntary departure?
Why didn't you go to immigration court when they sent you the Notice to Appear?
If it was not for a criminal reason, then it was because being here (and being caught) without documents.
Basically you are talking about 212 and 601 waivers which are usually used by EWI immigrants back at their home consulate to waive 3 and 10 year bars for being EWI here in the US. (3 year bar for overstay of 31-364 days; 10 year bar for a year or more overstay)
It is my understanding that these waivers can be used to waive an initial deportation. However, there are some limits. It can't be an aggravated felony that caused the deportation. You can't be inadmissible for other reasons, For the waiver, there must be an "extreme (not usual) hardship" to a US citizen by having you remain for the full duration of the 3/10 year bar.
And finally (but most importantly), there absolutely cannot be a 2nd illegal entry after a deportation. That is your lifetime bar. You haven't given enough facts that I see you are lifetime barred.
Either you aren't telling us the full story about why they will never let you in, or you need to find a much better abogado.
Good luck.

Disclaimer: Don't take advice about complex legal issues from unknown strangers on the Internet even if they have strange and cool sounding names. Go visit a living breathing immigration attorney who understands waivers better than the one you have already.
An immigration attorney is an expert in the subject. If you were told your case is hopeless then I guess you'll just have to make the best of it where you're at.
If you sneak back, and get caught, you'll go to prison. Don't try that, it's not worth it.
That figures. Someone trying to get into our country by obeying the law and they get deported because of paper work!!! I feel bad for people like you who want to come to this country legally and this kinda crap happens. Then the illegals come in here by the thousands and nobody does anything about it. Where were you deported to? You didnt say. Hang in there. Wake up America, this is a perfect example of the future of all immigants trying to come here legally.
oh well get over it
do what all the other illegals do.
