I used to live in miami under my mom´s work permit visa, there i met my boyfriend now father of our baby girl, now im living in Spain, my italian passport is taking way to long to renew but it expires in june, I need a new one to get the engagement visa there, so everything is taking tooo long, and I can´t wait any longer, can I go over to miami and get married there without getting kicked out or penalized?

It would be more worth it to you to do it legally.
You can travel on your valid passport and get married when you are in the U.S. This would be the fastest way to go. If you enter the U.S. illegally then you will not be able to adjust your status, if you later go out of status while in the U.S. you can still apply through for adjustment of status by marrying your boyfriend. Do not wait until your visa expires.
