I believe so, but there are alternatives and loop holes, that you can legitimately use. A month is too short a time, to apply for a pass port, in any case. You will have to, pay alot of expensive fees. Talk to legal aid and the proper officials, pronto.

It all depends on where you are going to go. If you are just traveling Mexico, you can use your state issued ID or Driver's License. I believe that Canada is beginning to only accept Passports. You should check with the US State Department. You will have to pass a criminal background check in order to get a US Passport. I believe so. It takes 6 weeks to get it back because they have to do a check but you can pay more and get it in 2 weeks.
If you are an American citizen applying for an American passport, a criminal background check is not done when you are applying for an American passport. Your criminal record does not have anything to do with your applying for your American passport. There is no questions regarding your criminal record in your passport application.
