I was deported from the US to UK two years ago, and since married my US partner. How do I return ?

Due to minor convictions and a TWO year overstay, I was deported to the UK Dec 04. It is causing great hardship as I have no family or anyone here. I only have my US born husband who is unable to be here with me , even though we tried, due to loss of his work. It is a very desperate situation and we no longer have the finance for lawyers, etc...
I have suffered with a loss of a baby and family members in addition and this is taking a toil to be away from my husband.

Answer:
Doing this without a lawyer will be hard work.

You say minor convictions. Please remember that what is minor in the UK is not always considered minor in the USA. The two year overstay is going to be problematic. As your husband is US born, I assume he has citizenship. Has he found decent work yet? Are his wages more than 125% of the poverty level for the size of family he will have if he petitins for you?

If the answer to the above questions is yes, then all you can do is have him petition for you. All you can do is tell the whole truth on all the forms and hope that the immigration officer who reviews your case is understanding enough to give you another chance. However, please don't get your hopes up. This is not going to be easy.

Whatever happens, I do hope you find peace in your life.
dont bother, America is all hype
You are banned for life from coming back to the USa. Maybe if you had behaved yourself, you wouldn't be in this fix. Giveup, get divorced and move on.
I understand you are banned for a minimum of 10 years after you are deported.

Why do you think you should have been able to break the laws and overstay in the first place?
You are banned for 10 years, because your overstay was longer then 1 year . Thats the law ,but maybe a lawyer can help you .
good luck
Deportation is usually a 5 year bar. The only way to come legally is with permission of the Attorney General of the USA or the Secretary of the Department of Homeland Security.

Before you spend the money, ask yourself the following question and give an honest answer:

Why would the USA want someone who has previously violated its laws at least 3 times to come back to the USA to live?

Find a third country like Canada.

Were the "minor convictions" drug or prostitution related?

If so, forget the dream and get on with your life realistically.

And if you come here illegally, it means jail time (up to 5 years) and then 10 year bar.

Sometimes a divorce is the best answer.

I'm sorry about your self made situation.
