when was the marriage date? before or after the canadian overstayed? if it was before, the canadian needs to go home NOW, like, today, and then the US citizen needs to apply for permision for his/her spouse to come into the US. if it was after....you are in big trouble. you need a lawyer, or you just need to move to canada and stay there. if you don't get a lawyer, you have very little chance of actually living married life with your spouse. really...shame on the people involved in this situation! i don't want to be mean, but it's your marriage!!! you needed to research the legal issues WAY before this point. i hope thing work out for you, really.
