I am working for a UK company in the US and have been here on an L1 visa with my husband and step daughter since September 2001. We filed the I-140 through the company lawyer along with the I-485 in May 2006, all at our own expense. We have received I-765 Employment Authorization and I-131 travel documents that expire at the beginning of July 2007, again, we are paying for this. We are still waiting for approval of the I-140 and I am told that this should happen in the next few months. My dilemma is this. I have heard on the grapevine that I may lose my job at the end of the fiscal year (March 31st). If I lose my job do I lose everything? Will I have to move back to the UK with my family? My laywer does not know about this and I do not want to ask her advice as she is also the company lawyer. What are my options if I do lose my job? I really, really do not want to go back to the UK.

Hello, I've read your concern. I suggest that your husband or you should get another job before the company goes out of business. The new employer can sponsor you and there's something called grand-fathered case. You mught qualify for that. If you need more information, please feel free to email me.

I believe that there is a way for you to self-petition for a green card based on having spent several years on the L-1. I know that this is possible on the H1 visa. You should contact a lawyer immediately, because if you lose the job then the L-1 will terminate and you and your family will have to return home. This involves a personal matter and not necessarily involved with the company if the company plans on firing you. You need to get your own lawyer who specializes in L1 visas. The company lawyer will not advise you on matters not involving the company.
