If you apply legally, they will find out about your jail time. It depends on what you were convicted of. Crimes of "moral turpitude" are a big no-no. Minor offenses will allow immigration some discretion but don't get your hopes up.

Probably not legally, but a good immigration lawyer can work this out for you if it was something like an immigration violation or some such. If you did time for something really bad(like armed robbery or a sex crime), I wouldn't think even the best lawyer could get you off. Thing is, we don't really have a shortage of criminals here, and we don't really want any more.
