Well..The best answer that I can give you is this. According to the letter of the law, a person who is not a legal citizen or someone who has a green card( this card is in essence legal permission to work and hold a Social Security card) is in the US illegally. Now there may be some exemptions for stdent visas etc.
But basically if you have no legal right to be in the US, then you are breaking Federal Immigration laws.
That is why we have an Immigration Dept.
So, to answer your question, yes it is illegal to be an illegal immigrant.
Now as to Bank of America doing what they are doing, all I can say is this. Bank of America is very pro-immigrant due to the fact that they are a Los Angeles based company with a large Hispanic employee base.
Also as everyone knows banks are in business to make money thru fees and credit card fees and interest, so what they are doing is tapping into a new revenue base.
But...There is a good chance that the Govt. will force them to stop doing this. I understand that the Justice Dept is investigating this.
But that is right in line with the pizza place in texas that is accepting pesos as payment for pizza. Technically the coin of the realm so to speak is the Dollar, but these people see this as a way to tap into a new revenue source.

Following your line of reasoning, an immigrant can't be legal. It is merely a way of defining an immigrant's STATUS in this country.
They are either LEGAL OR ILLEGAL. Period.

My concern is that when the Bank of America (which actually is majority owned by those not American) goes belly up over this foolish stunt that the United States doesn't offer to bail them out like the did years ago with the Savings and Loan mess.

The individual cancer cells are not the problem, but when these cells lodge into a vital organs like healthcare, education or the prison system just to name a few, the body nation begins to fail, compromising the entire organ system. We all know what must be done, we just don’t have the stomach to say it, let alone do it. To save the body we must eradicate the cancer that threatens the body.
Illegal immigration is illegal, hence the name. That's why I don't understand why some people treat them with the highest respect when criminals who have committed crimes of equal or lesser value get the shaft.
