How can I obtain a visa to my wife, who overstayed her J-1 visa in the past?

I met my wife when she was an aupair in the us and she overstayed her visa. When she decided to go back to Brazil, I went with her and we got married. Now I would like to know what should we do to come back to USA.

Answer:
U both have to apply for her in the US Embassy in Brazil. The law is harsh on people who overstay their visa. They must apply in their country of origin & wait for approval that is no less than a year & not more than 4. U will face an uphill battle cuz overstaying a visa is a serious offence for the INS. Many people screw their future chances when they don't take seriously overstaying their visa.
if her overstay was under one year she has a 3 year ban .if over 1 year she faces a 10 year ban . maybe if the overstay are just some days you guys have less problems . good luck
no.... does anyone know she overstayed? how did she get home? if it's not documented when she left...it doesn't matter. i mean....if you can live with being dishonest, it doesn't. the idea is, she left and hasn't entered the US illegally right? it's not so much the exit that is the issue, it's the entrance. you need to get an appointment soon in brazil, it will be about 1200 dollars, plus lawyers fees if you need one, and....about 9 months of your time.
