Can my friend still invest $ 500.000 in a company and obtain a green card?
my friend came here legally, SHE HAS A M-1 VISA
she graduated from school, she found a sponsor, who filed for the green card,
but the immigration canceled her papers cause it couldn't get the Dept of Labor approval on time.
now she has an ( M-1 ) visa she got from the usa embassy for up to 2 more yrs, since 2004
but when she came here the custom agent at the airport put a stamp that allowed her to stay until the school is over.
but the USA embassy's ( M -1 ) visa states that the visa is valid until 2009.
she thinks she is out of status because of the whole sponsoship mess.
but can she still invest while she is in the USA?
though she might be out of status?
I heard that if you invest $ 500.000 you can get a condditional green card.
what can she do?
can anyone answer ?
Answer:
The maybe out of status part she should check with an immigration attorney. I understand they can do more for those who initially came legally than for those who didn't, though, and at least she has a colorable argument because of the school stamp bit.
As to the $500,000 investment, if it is in certain types of business, that is still enough. You'd need to go to uscis.gov for details, however, since she needs to go to an immigration attorney in any event, she can ask about that then as well.
the only logical answer must be see an immigration attorney.
My Friend is would the best not to ask this kind of questions here, The Gentle man above is very right.
But i know for sure that you can not get your Green card with investing only $500.00 .
That requires a much bigger business that employs a few American citizens.
Good luck to you and your Friend.
This is a very involved fact pattern. She really should seek assistance from an immigration attorney to fully evaluate her options and eligibility for anything.
The E-1 and E-2 Treaty Trader and treaty investor visas if she is from a treaty country come to mind. There is no set investment amount, just that a "significant" amount of capital is placed at risk.
The EB-5 investor category is for those seeking permanent residency.
