What if your 2 years temporary G. Card has expired while waiting for the Immigration answer on your case ?
What would her status be as a result ??? Her 2 years card has expired during this process.Would the INS accept her new status & let her apply again after she gets her divorce???
I must remind you that her husband has complained to the INS that she used him to get Visa status in the US.
Do you have knowledge of what would her situation be ? Please, don't give advice such as talk to a lawyer. I wouldn't be on Yahoo Q & A, if i have to do so...would i ?
Answer:
This case is not really common. Instead of using this Yahoo Q & A, she actually needs to find an immigration lawyer if SHE wants to stay here.
I understand why you care so much about your friend. But this is her problem not yours. She is the one who needs to find out how she can stay here. If she doesn't have time to contact a lawyer or to try to do something about it. We can't do anything about it. Probably you are trying to get as much information as possible by posting your question on the website like this for her. But this is not the official wesbite that people actually get the solid correct information. I'm not saying that all people who answer the immigration matters on this website provide wrong information. But her case is very serious, and I do believe that she obviously needs to find solid answers from someone she can really trust.
Anyway, I'm Japanese and I know an immigration lawyer that you can contact by e-mail. It's free and he will reply to you as soon as possible. So e-mail him: http://www.horitsu.com/
Yea, she goes back where she came from.
Normally what happens when filing to remove conditions is that USCIS will mail out an extension letter that to extend Permanent residency for 1 year while the greencard petition is processed.
Has she received any kind of notice from USCIS in the mail that shows her petition to remove conditions alone has been accepted and is being processed? She should've received a Notice of Action (NOA) receipt for her petiton and then a NOA for fingerprinting & biometrics. If she received either, she could make an infopass appointment and ask for a temporary stamp in her passport.
If she has received neither, and its been awhile since she mailed her petition in, she may very well be out of status. I would suggest she make an infopass appointment to find out what is happening with her case.
Your friend seems to be in the same situation you are, using an American citizen to get a green card.Go back to Russia.Your name used to be Alena, now it is Maria?
