What's the status?

My friend went to the states in 2004 as a tourist, she then divorced her husband who is in the philippines. on 2005 she got married to a US citizen and until now she's still waiting for her citizenship papers. what is her status in the US as of today? did she violated any immigration law? during her waiting period, is she considered as an illegal alien?

Most people came here with B2 visa with 90 limit. Unless she petition for extension and granted by government, she became illegal. In most of case, her husband would have file I-130 and she should have her two year limited green card by now.(Even thought she is illegal)
In her case, she was married then divorced after she got here. She get married very fast. She is from Philippine. the ICE is looking for "Green card marriage". There are very good chance that USCIS rejected her husband's petition, and she is here illegally now at this time.
so if she is waiting for her citizenship papers, it means that she has a green card already, that means that she is a legal resident of USA.
Well, she was illegal when her tourist visa ran out. And unless she has something like a green card (which you get before citizenship) she is illegal still.
maybe your friend is not telling the truth. how can she wait for her american citizenship if she's not holding a greencard.
