My girlfriend's husband wants his wife deported. Can he do that?
He recently started a relationship with another woman and told her he will get her deported and that way he don't have to give her anything. They own a house, a few cars, and a few other things. All of which they purchased while they were married.
She works a low paying job and can not afford an attorney. She is so isolated, terrified, and totally depended on him.
Does she have the right to stay here? Her mother (also German) lives here with her step dad. Is it possible for the sponsor ship to be transfered to her step dad?
Please help I don't know the answers, I just met her a few days ago and would love to assist her.

No her husband can't have her deported. He can however, refuse to file jointly for the Removal of Conditions on her greencard. If he refuses to file jointly, she can attempt to file on her own if she has enough evidence to prove that the marriage was entered in good faith.
If she suceeds in removing conditions on her own, her ex-husband will still be held liable for the affidavit of support, even when divorced. Once signed, submitted and approved by USCIS, there is no way to void the affidavit of support except by having the immigrant leave the US.
And, no, her Step-dad will not be able to sponsor her. Her mother could though. But if her mother is only a greencard holder herself, it would take many years and your friend would need to leave the US while waiting for it to be processed.
yes if he make over 25,000 a year her husband only had to make 20,400
im not an american.the way i see it is she will never deported because she's already a greencard holder.if she did not committed a felony then what is the ground for her to be deported.because her husband started a new relationship with another girl.that is not the ground for her to be deported.if she is the one who left her husband for another man and taking advantages bof him then he will refuse to sign the greencard renewal.the best way is to consult the immigration office in the state and ask whre she stand on her renewal of her greencard.
Are you sure she has a green card? They only have to be renewed every ten years!

If she has a conditional greencard she can file for the removal of condition on her own. She has to prove that the marriage was entered in good faith tho . For more info go to www.visajourney.com
