My girlfriend is in the country illegally and we want to get married. What should I do.?

She is 18 yrs old. Her family (mother,father,2 brothers) have been in the states for over 5 years.

Thins to do to be with her:.
1. You cannot marry her here and get her legal status here. She needs to go back to apply for visa in any scenario.

2. Lets assume, you married her here. Then you submit I-130 on her behalf. Whixch is denied and forwarded to Cuidad Juarez consulate. At this point she needs to go there. She will have interview there - denied and need I-601 waiver of inadmissability. Yuo need to write it (yu can do it beforehand - its difficult) and submit. Once approved, she comes here.

3. You can go with her to mexico, and get married there and submit papers. It will be similar.

4. Once she will be returning back, make sure she has some evidence that she is marrried to you, papers filed on her behalf, or else. This is in the case if she will be stopped by border patrol - she wont get deported, once they see that she is going back to do everything proper way. If caught and deproted - more headacke.

5. Father, brothers and so on likely will never be here legal. She wont be able to sponsor them, and overcom all inadmissabilities.

I thought, that if you get married, then you can stay in the country. I may be wrong. Otherwise, try to get her to be a citizen and get married. Do it the right way. Then you don't have to deal with the consequences.

My best advice is to seek a consultation with a competent immigration attorney. Much is forgiven when married to a USC but this only applies if one was inspected and granted entry to the US. As your fiance wasn't inspected on entry and is now 18 years of age she is not eligible to adjust status through marriage to a USC. Once she turned 18 her illegal status came into play. There is a very reputable and well known lawyer (Laural Scott) that specializes in those from Mexico. Have a read of her website below. Your fiances only choice may very well be that she has to return to Mexico and a petition filed on her behalf. A K-1 fiance visa would be the go as there is a almost a 12month wait for interviews for an immigrant visa if you get married and file an I-130 petition as your spouse.
I do not think there is a way she can be legal in the country even if you marry her. An amnesty would be the only solution for her to become legal. You will just have to wait for the president to forgive illegal aliens who sneak in the country.

Legal immigration is possible no matter what people may say.
Have her go through the same steps that my grandparents (and many, many other immigrants did) to become a legal citizen. And while she is at it, have her learn English like my grandparents (and many, many other immigrants) did. People that come here from countries that use entirely different alphabets learn (example: Chinese). She is at least as intelligent as them, isn't she?

As for her family - same thing. If they want to dance here, let them do the right steps.

Persons from her culture tend to get pregnant and married too young in my opinion. Stand back and take a good look at YOUR situation. 2.- get a fiancee visa

3.-bring her back to the us legally and then get married

Do the right thing and report them to immigration. You are an American, right? The law is there for a reason.

Here's how they work; They marry you and have a kid. This gets them citizenship. Then they divorce you, sue you, and are free. It happens all the time. Don't be a fool by falling for this old scam.
