Married to a U.S citizen?...?
Answer:
If you are in the US illegally, that is you were not inspected initially and granted entry then you are unable to adjust status even if married to a USC.To adjust status to that of a permanent resident through marriage to a USC you must be eligible to do so. My best advice is for you to seek at least an initial consultation with a competent immigration attorney. Not doing so may cause you unnecessary complications. You should be able to seek this consultation through the marines.
i am trying to find out the same answer??? let me know when you get something and i will let you know when i get something....
no... file an Adjustment of Status, Form I-485, together with your I-130.
YUP! Don't know how long it will take but you MUST go back to your home country to start the paperwork.
Marrying a citizen doesn't give you automatic citizenship!
You might have to return to your country, but I am unsure. My husband and i have just completed the INS process but we started the process in his home country.
I do not think the relative of an an illegal alien has the right to file the I-130 because the relative is NOT legal in the country. You will have to go back to your country and file the paperwork from there. I do not know how long will that be maybe 2 years, but the wait will be worth it because you will have the right to live and work in the USA.
You may take your child and wait there with him, do not expect things automatically because your husband and son are US citizens. Many people are waiting and you will have to be in line.
My advise is to do things legally for your husband and child. Stop being a criminal illegal alien ( you may not like it but is the truth)
Talk to a lawyer before filling anything do not waste your money filling the I-130 if it is not going to preceed because of you status in the USA.
You will go back for 2-3 years. He can go with you.
Its amazing how much bad information there is floating around out there. Don't do anything until you consult an immigration attorney. Some of the answers above are very, very wrong and if you do what they suggest the consequences are very severe. Even if I answer your question correctly, you have no way of knowing whether I'm right or wrong so my best advice is to cough up the cash for a legal consultation.
