HELP my fiancee is in jail with an INS hold?
Answer:
Depends on how much money he has for a legal defense team. if he is a first offender he may get probation. If only he was the son of a Mayor he would be found innocent, like our mayor's daughter was found innocent of DWI even though she was on tape, seems the officer could not recall the facts of the arrest and his superiors said he made lots of mistakes during the arrest, that he was only a cop for 2 months, ain't justice great!!
If he is found guilty, he should. and probably will be, be deported.
Contact an attorney ASAP, either a criminal defense or immigration attorney.
Greater than a 50-50 chance he'll be deported. The laws written in 1996 have been made tougher to fight by the Patriot Act. And it will be highly unlikely he can apply for re-entry to the US.
It won't really help if you get married. Ask yourself why you would want to marry someone who has so much drama anyway. "Felony marijuana" is more than just a little joint.
Good luck.

I agree with vegaswoman. Maybe you should go live with him in his country, if you love him so much. No, it won't help for you to marry him to try to keep him here - that don't fly anymore.
That's a lot of pot and a felony is a felony whether you're married or not. Hopefully they will deport him and you can find a better class of loser to hook up with.
Not only is he going to be deported. He'll be banned from returning to the United States for life. He'll be lucky if they don't prosecute him and make him do jail time before deportation.
