Immigration Question – Illegal immigrant, British baby.?
She had a relationship with a British man (an alcoholic, and a complete idiot by all accounts), and became pregnant (she claims accidentally). The baby was born in October 2006. The British man initially refused to be named on the birth certificate as the father, however after a DNA paternity test he agreed. So, the baby will have British citizenship.
However, my question, that we would be very grateful if anybody can answer is, how will this affect the mother’s immigration status. Will she remain illegal? We believe she can claim child support for the baby, but what about other benefits? Can she get a council flat?

Hello, I will tell you my experience cause I was in the SAME situation- except for a couple different issues... I am from the USA and my bf (at the time) and I were still together.
The UK will NOT help her- if she is anything like my situation. They threatened me with deportation and I would have gone WITH my baby- my bf never ever claimed that he was not the father. I was unable to work, claim ANY benefits or anything like that and my bf could claim nothing for me either or even child benefit!
We eventually got married though. I had to go home to the states and apply for my settlement Visa. This was two years ago though, and I think the laws for these family matters are getting harder and harder- not easier. So your friend may have the fight of her life coming to her quick and in a hurry if she doesn't try to sort something out now. Its better to get it sorted now, then wait until customs and immig. are knocking at the door. For her sake and her children's sake!
On the other hand- if she has been in the UK illegally for 5 years and has managed to live and support herself with no recourse to public funds- then if she can manage to do it for 6 more years- she can apply for citzenship. its all on the UK VISA website... Ive combed over it countless times during my tribulations trying to stay in the uk.
