Is charging people more than $10 to immigrate unconstitional?

I thought about the recent immigration measure proposed in Congress and then I remembered this little detail in the Constitution.

Article 1 Section 9.
The migration or importation of such persons as any of the states now existing shall think proper to admit, shall not be prohibited by the Congress prior to the year one thousand eight hundred and eight, but a tax or duty may be imposed on such importation, not exceeding ten dollars for each person.

I would point out that this is still valid. And would it make the recent proposal unconstitutional?

What does such matter when your talking about a group of people that are known to be breaking the law?

Personally, I wished they would just address the real issue of them breaking the laws and quit trying to sidestep that very important point of the issue.

Per law, a person that has a criminal history is not going to be one that is going to have easy access to obtaining citizenship to begin with. That some within gov. are trying to sidestep this important point is something that everyone needs to remember next time they are up for re-election.
America does not need or want any more immigrants, legal or not.

In any event that would shift it to state rights to control immigration, which is almost better - although I'd have to move from California.

The recent proposal calls for a $5,000 fine, not a duty or a tax. I don't know where those funds would go or who thought up this ridiculous figure for poverty-stricken people.

Maybe the employers who hire the immigrants and "temporary workers" should be held responsible for paying their fees to immigrate. As for the ones already here illegally, nothing would be suitable short of deporting them all. They should not be rewarded for being "smart" enough to elude detection in the USA, being here before January 1, 2007. If this goes through, there will be another even larger swarm of illegals into the country, believing another "amnesty" would be awarded a few more years down the road. Why shouldn't they believe this? We've already proven to them that it does happen every so many years.
