HELP!!My girlfriend is gonna be migrating and?
the thing is her dad is filing for her to get her green card,, n i was wondering if it is better for us to get married before or after she gets her green card,,,,,
which way would be quicker n less hassling
Answer:
Yak rider is correct.however, you may have another problem to think about...if her dad has already filed his petition for her, it will have to be withdrawn before filing the K-1.
Pack your bags
if you are an american citizen and you marry a forigiener then you can give her a green card
Birds migrate..
It will take her dad at least 5 to 7 years go get her a visa to come to the US. If you apply for a fiancee visa it will take 6 months to a year of her to get the visa. You do the math.
Yak Rider is correct. The only questions I have are:
Do you earn more than 125% of the federal poverty level?
Are your tax returns up to date?
Both of these questions are rhetorical, of course. If you can answer yes to both of them you should look at getting a K-1 visa. that means applying for her to come here, marrying her and applying for a work permit and Green Card.
EDIT: Now you have clarified the situation, things are more complex than anyone offering an intelligent response could have figured out from your initial post. Either you get in on your own (family or employment-based being the most likely) or you wait for your girlfriend to get in (5-7 years) and then wait for her to get her citizenship (another five years) so that she can petition for you to come in as her fiancee.
