Can a mexican that is not a U.S. citizen be legal if he had a child with an U.S. citizen ?

I know a mexican who's driver's license will be expires soon. That person is not an U.S. citizen yet and said that he can not renew his license. That person had a child with an U.S. citizen just recently and wants to know if they can become legal in the United States. That person did not marry the U.S. citizen and doesn't plan to. Can they become a U.S. citizen by having a child with a citizen ?

As I understand it, he is not a legal resident unless he marries an American citizen. However, his child (whether both parents are immigrants) is a US citizen.

If he's not a citizen how did he get a US drivers lic in the first place? No you cannot automaticaly become a citizen if you marry one or have a child,it is my understanding that you have to return to your country of origin complete the proper paperwork and wait for approval.
technically yes. because the child is a citizen and the US immigration will not send a parent back and make the child stay, nor will they make a citizen (the child) leave with their parent. i wish everyone who answered would think before they wrote.

The answer to that is sadly no. I know someone who is an illegal immigrant that married a US Citizen (who is now pregnant) and he will soon be deported. If you marry a US citizen it doesn't make it any easier now a days. Long ago, immigrants were able to marry a citizen and easily become one. Now they are very strict on that. So when an immigrant plans to marry a citizen and apply for citizenship they keep a close eye on them even if they are living together already. This could go on forever.

NO. And, even if he did marry a US citizen he would not be given legal residency. That's the law - your friend needs to talk to an immigration attorney and understand what he is facing.
He has 2 choices - stay here illegally and deal with that. Or, go home to Mexico. If he ever does marry a citizen he will have to go back to Mexico in order to get legal entry - which he may Never get - married or not.
