What is the present legal (resident) status of my wife, who is here 5 yrs. and has applied for a green card?
Answer:
If she's not here on any sort of visitor visa, she has no legal status at all. The application process means nothing and if she is found to be here illegally during it she can be banned from the country permanently. I suggest that if you have further questions, you should hire an immigration attorney.
"Application in process" means nothing...she is ILLEGAL.
And what benefits are you guys getting from the government on my tax dollar ?. Send her home...No better yet go back to her country with her until she has her green card and is legal. Then, please, come back and be productive citizens.
To answer your question, I don't know. It's impossible for anyone to know without more information.
When did she come here?
How did she come here?
Did she have a visa when she came here?
If so, what kind of visa did she have?
If she had a visa is that visa still valid?
If she had a visa and it expired, when?
What did she do when it expired?
Answer these questions and I can tell you her status.
