My foreign partner has Indefinite Leave to Remain in UK but can we both live in any other EU country now?

She has full residency rights to live indefintely in the UK but does this give her automatic rights to live in other EU countries in the same way as me? I come from N.Ireland and we are considering living less than 20 miles away in the Irish Republic but are unsure if she can live and work there too.

Answer:
Sorry Frisky, but your advise over the EEA permit is rather dangerous. The EEA system is run under European law so if that advise was followed, it would be back to square one for the lady in question.

Indefinite Leave to Remain in the UK does not give your wife an automatic right to move to and reside in other European countries. You would have to apply for a spouse permit under EEA rules. But as I pointed out already, that would effectively re-set the clock as far as any citizenship application is concerned. Under UK law, your wife has to be a resident of the UK for three years before being able to apply for citizenship (its four years under EEA rules).

So yes, you can do it but the citizenship clock is re-set to zero. Perhaps better to wait until your partner is a UK citizen?
not necessarily but in general if u are married to a eu citizen u have the right to live in any eu state

i am a south african married to a British citizen living in ireland
not until they get a red pasport from uk, then they can live in europe, Leave to Remain in UK can mean being allowed to live here on your national lands passport
If the situation were reversed I'd say apply to the British for an EEA family permit. Suggest the same in his case - with you applying to the Irish Interior Ministry - or whatever they have. She has no automatic rights to remain in Eire.
Yes, I have to agree with Caesar, it would be better to get UK citizenship first. I'm sure that it would be possible for your wife to live with you in the Irish Republic under their equivalent of an EEA permit, but it would complicate and delay the process of obtaining UK citizenship. Once she has that, she would be free to live in any EU state.

Why not live across the border in NI until it comes through? I don't think there would be anything to stop her working in the Republic. She is also allowed to spend a certain amount of time outside the UK without jeopardising her citizenship application - no more than ninety days in the last twelve months before applying.

Good luck.
NO - SHE WILL NEED A SCHENGEN VISA TO TRAVEL TO ANY OTHER EU COUNTRY AND CANNOT JUST LIVE ANYWHERE IN THE EU.
