Marriage to green card holder?
Me and my wife applied for asylum before marriage (different cases). My wife already won her case and she's about to get a green card. My asulum judge is in 2008 only. Can I cancell my asylum application and apply for green card as spouse of green card holder?
Thank you in advance.
Answer:
1. If you got married before she was approved for her GC, you can apply for Join in benefits, and receive GC with her.
2. If #1 doesnt work for some reason, go to 2008 hearings with judge. If you applied under same conditions as her and there are no com0lications, you might get GC as well.
3. (if #1 and 2 failed)As a GC holder she can sponsor you for the GC through marrriage. The problem is that the wait for this application is currently 5 years (due to limited number of visas available). You will be allowed to reside in US, you will be allowed to work (Under employment authorisation document), yous you will be entitled to advanced parole for travel.
4. You can apply for #3 concurently with having #2 pending. It is 2 separate cases, you can have both of them.
No.
Green Card holders can sponsor a spouse but you'd have to go back to your own country and wait about 5 years for a visa.
Don't do that. Yak Rider is right. You cannot adjust status quickly through marriage to a green card holder. The spouse of an LPR falls into the F2A category of immigrants, for which the backlog right now is 22 March 2002. Check the Visa Bulletin here:
