My girlfriend comes from Brazil she as to leave march, can she go to France for the day and come back and stay
Answer:
yes she can apply for a work permit but that may not keep her in the country legally if the process takes over eight weeks. I'm not sure about the travel to France thing but if she were to return to Brazil for a few days to a week she should be able to return for another six months. Before betting on this i would check with the State Department first. Before i got married i was stationed in Iceland and my boyfriend lived in the US he would live with me for 90 days on his tourist passport then return to the US for a week then come back for another 90 days. Airfare was expensive but he had no problems returning. good luck
is she an illegal immigrant ?
she would have to go for more than a day
Why doesn't she just go home to Brazil???
I assume that your girlfriend entered the UK with a Visitors Visa for the maximum period allowed (6 months). If this is the case, once said Visa has expired, she will not be able to return to the UK simply by leaving for a short period. Once the maximum period for this type of Visa has expired, she will not be able to apply for the same for some time. I further suspect that she will not easily be able to enter France without a valid Visa for that country.
A work permit can only be applied for by a potential employer and not by the potential employee. A work permit will only be issued under specific circumstances so it is unlikely that your girlfriend will identify such a job in the limited time left before the expiry of her current Visa.
It appears that your only other avenue is to apply for her to remain in the UK as a fiancee. This is not a straight forward process as Immigration authorities will suspect that your girlfriends intention was to remain in the UK from the outset.

Listen to Paul H above ... and as he says go to the IAS, I believe their services are provided free of charge.
If she needs another 6 months to stay after her visa runs out, then she can go abroad shortly BEFORE it runs out and come back, and at the entry, she can explain and ask for 6 months visitor status. But if she goes out when her visa has run out, then they will refuse her entry, so she has to go back to Brazil before she can come back. As for the work permit, without having an employer that gives her a job which is difficult to fill in with native workers, she can not receive it. The job has to require either NVQ3, or a degree or 3 years worth of experience in the chosen field, for Home Office to issue work permit, so it is not easy.
I am sorry that I am probably not giving you any good news, but that's how it works, unfortunately. How about if she enrols to a school and applies for a student visa? That may be the best option for now.
Good luck.
