Green card question?
I-751 Petition to Remove Conditions on Residence:
Hi,
Just wondering if anyone has had experience fileing the above form.
I have the 2 year 'conditional' green card right now which expires Oct 8 2007.
I have been told to file the above form anytime from July 8. Does anyone know an approx time scale on which I will recieve my new green card?
From my dealings with the INS is the past I am envisiaging I will not recieve the new card before my old one expires. Is there some way of obtaining some sort of temporary work card before this happens?
Do you know If I have to fill out more forms and what the fees will be?
thanks in advance for your help.
Answer:
You can file the joint petition within the 90 day window before expiration as you indicate. USCIS will issue you an I-797 notice acknowledging receipt of the petition. This receipt notice will state in the body of the form that your Permanent resident status has been extended for one year.
For travel or work purposes, you'll want to carry both the expired card and the I-797 extending the status. I know until recently, the Boston district office would be willing to stamp your passport with a temporary stamp upon presentation of the form and expired card (just so you have proof in your passport). I'm not sure if they are still willing to do this, but you can make an infopass appointment once you get the I-797 and give it a shot.
One last note, the I-751 takes over a year to adjudicate, so it likely won't be decided by the time you become eligible to file for citizenship on your three year anniversary of permanent resident status. You can file a naturalization app. notwithstanding the still-pending I-751. What will happen is when you're interviewed for cit., the I-751 will be decided as part of the interview.
Good luck
