If my huband and i are foreign nationals and we have a baby born in the united states can we get citizenship?
Answer:
No. Nope and No way.
Sorry, but as current immigration law stands, your baby is free to stay but you both would need to leave.
You shouldn't be able do.
I think your baby should be...but personally, if I had anything to say about it you would be DEPORTED.
If you aren't fugitives from the law, etc., you will be able to APPLY for U.S. citizenship. Having a baby here makes the baby a citizen - not you.
Only when the baby reaches 21 years of age, he/she can sponsor you for a green card first. 5 years after that you can apply for citizenship. Till then you are on your own and the baby cannot help you in any way to get GC or citizenship.
no go home.
Nope, sorry ....
no... now go home
Ramshi is correct. The baby will be a US citizen, but that will do nothing for you. He can petition for you when he turns 21 if he wants to, but in the meantime your status does not change.
Not necessarily, I believe the way I heard it works is.....Your baby is considered an American but you are not. You will have to obtain citizenship the same as anyone else. However your baby will have dual citizenship and at legal age (18) it can choose if it wants to remain a citizen here or where you came from.
No. And the baby will not be a citizen either but can get a
citizenship through naturalisation when he/she is 21...
the baby yes ...
No. Having a child born here does not automactically entitle you to US citizenship.
