I am thinking about applying for a k3 visa or a k-1 visa and my income stated on my tax return is below the rquired ammount to qualifiy, how will my accets factor in?
Answer:
If you do not have income 125% over the poverty limit for your family size, you liquid assets may be used to make up the difference. However your assets must be worth 5 times the difference. For example, if you must make $20,000/yr but only made $15k, you lack $5k in income. Your assets (anything that can be cashed in within a year) must be worth 5 times this amount ($25k) to reach the 125% minimum. You could also have a joint sponsor assist you.
If you don't have enough income, then you will need substantial assets or a co-sponsor. If you don't have a lot of income, but you have a lot of savings, then you can use that in your affidavit of support.
