I really need to know what is what I need to do in order to legalize my boyfriend once we get married this mon

He has been in school ever since graduated from high school & is even enrolled in Cal State to get his masters degree in art he is very close in finishing! But we want to get married & I want to fix his illegal status to U.S. citizen. Some people have said that once we do get married he has to leave the country back to Mexico for a year so that he can get all the other paper work over there. But he doesn’t know Mexico & doesn’t even know Spanish that well either. I have also heard that he maybe just needs to pay a fine & doesn’t have to leave. I thought that me being a natural born citizen it wouldn’t require him to leave the country. Can you please help

no need to go back to home country. after marriage you can apply for his green card. you might have to pay some fine but nothing major. check the following site for detailed forms etc and contact an immigration attorney before filing.

It is an "ifie" situation...because if you read the Law, certain aliens can never become legal...just read it on the INS's website...it has been a while since I read it, but I believe people who have been here illegally for a amount of time can not become legal...as well as deportees or someone with a felony... you best bet is to read the site...that is what I did...
first, before you listen to anyone here, it's always best to talk to a lawyer.
from what i know, what you've heard may be true. but if your boyfriend was brought here while underage, especially a young child, i think there may be exceptions for him. i don't know for sure, and you should speak with a lawyer who specializes in immigration law.
If he entered the country legally even though he has overstayed you can apply for a I-130 for him after you get married. If he did not enter the country lawfully and "jumped the border" than he's going to have to leave the country and come back...It doesn't have to be Mexico it could be his original home country or Canada.
If he hasn't come in legally to begin with, I understand there will be a ten year ban. You need to speak to an immigration attorney.
