How can I divorce a man who married me to obtain visa to the USA?
Answer:
Get a lawyer and file for divorce or annulment . That man has no rights to your child,do not send him any papers what so ever and get a restraining order and save all his emails and correspondence and tape his phone calls if he makes any and show your lawyer.
Middle Eastern men do not respect woman..that is a common well known fact, which I am sure you are well aware of by now.
Shoot the ****** and plee insanity.
First off, I don't know what he could send you to jail for and under no circumstance should you send him the copy of your child's birth certificate. Talk to both a divorce lawyer and an immigration lawyer. Make sure you tell the lawyers everything detailing that you believe he married you to obtain a visa.
You might try looking for a good immigration attorney. My first place to call would be immigration to report him as having ulterior motives and manipulating you. Actually marrying you under false pretenses. This could get expensive with a child involved. Good luck.
I don't know I'd go the way of trying to have his Visa revoked and have the marriage annulled instead. Pursue all and any avenues to prevent divorce because he will use this as a means to further abuse you . also have you've been saving all the e-mails and such that will prove your case, most agencies, lawyers, what have you, like to have any and all evidence ready at the front of the case as well as providing a time line to coincide with your facts ad evidence.
DONT SEND HIM ANYTHING ! YOUR CONGRESS PERSON MAY HAVE SOME PERTINENT INPUT OR SENATOR. THERE MAYBE LEGAL ADVICE AVAILABLE OVER THE PHONE. CHECK THE INTERNET UNDER DIFFERENT SEARCH HEADINGS. I SUSPECT HE'S TRYING TO GET THE CHILD. BE CAREFUL !
Try to behave him with good manner for your child and try to make compromise with him, also consider yourself if something wrong from your side ,ifnot then too forgive him make yours life better with your baby.
Get a lawyer who specialises in immigration law.
You can't "amicably" separate from a violent nut case.
He can't come here without a visa and you are no longer his sponsor.
You can divorce him without him being present. Get an attorney and do it. Don't send him anything to do with the child.
Women have no rights in the Islamic world, tell him the USA isn't part of the Islamic world. You've got rights here, use them.
You are in the USA and he is in Egypt. You withdrew the petition so he cannot come to the country with the marriage papers. Why is he going to take you to jail?
Talk to a lawyer and have proof of his messages, phone calls, whatever.
Call the US consulate in Cairo and ask what's going on?
I have no answer to your question, sorry =[ but I do have something to say. Don't generalize everybody to be like that, I know you haven't said anything but the answerers have. Just because one has done it doesn't mean all. That gets me upset, not everybody in a race or ethnicity group is the same, there is everything in everybody.
He is in Egypt - Make sure he cannot reach you from there (No friends or better doesnt know your address).
1. You did well by withdrawing the petition.
2. Child is yours and only, that doesnt entitle him to anything. (e.g. visa or what).
3. Dont listen to threats - he cannot do anything, Dont lesten to pleas - he will be trying to appeal to you to be "Humane".
4. Go to USCIS (Infopass appointment on www.uscis.gov). Make sure that they will put him on some "blacklis" so he canot get any visa to US. Marriage fraud is a crime - with lifelong ban on entering US. Even if you were deceived that it was a real marriage, since he only wanted visa, it is considered fraud. Explain to USCIS his threats and life threats as well.
They might guide you on something - I really hope they will.
You need to contact the State Department Passport Division, and contact ICE. However, if you get divorced within two years it is a prima facia case for marriage fraud.
