How can I get the property of my grandfather which had been shared among my fathers brothers without my will?
Answer:
you can take it to court. call a lawyer and talk with them about it. good luck.
UNLESS it was clearly stated within his will that you was to get such and such then I believe that you are not actually entitled to anything.................
Of course if you have a signed sealed will that they are not aware of how come you have not come forward prior to this.
Sad to say but unless they WISH you to have something and you can always ask...............you get zip................
You very well may NOT be eligible for anything. If it is not legally yours you are out of luck.
You are not you grandfathers son so you are not entitled to anything. Your grandfathers property belongs to his wife, then his children if she is dead and is normally split equally.
You have no rights to any property and you sound greedy.
If there was something which really was very important to you and was not so valuable you could ask to get it as a memento but it sounds like you "want your share of the loot".
define will
legal document or
your approval
If you are talking about the USA you have no rights with out the legal document.
If the property is in some other country with different laws, you need to look there.
a person can only claim a share in the grandparents if it's been inherited,i.e. the property has been passed on by their ancestors. Property bought by the grandparents, by their own income, will and can be shared by their children, with or without a will. Will's came into existing, a few decades ago, before that it was just an understood, that the property will be shared by the male members. But since joint family living was the "In thing", no one had any disputes. And of course greed came later and so did the legal option of the "Will".
Not a legal consultant myself, but sharing from experience on the said topic and taking the Indian way of living.
If there is no will, your father & his brothers have only, 'Right to Enjoy'. They cannot sell or gift it. The total right on on property is only with the grand-children, if the Grandmother is not alive. Consult, a good lawyer.
you will get your fathers share. go to civil cort. and also file a petition for cheating ,to criminal cort
SINCE THE LAWS OF ALL COUNTRIES DIFFER-FIRST OF ALL-WHAT COUNTRY ARE YOU IN? IF USA-WHAT STATE?
