What if we marry, She (American) and I (Under TN Visa)?
Thanks for the help...
Answer:
As the spouse of a US citizen, you would qualify for an immediate visa. After you marry, have your wife submit a family sponsorship packet on your behalf (I-130, I-864, I-485). Your wife will need to provide her income tax return for last year to show that she makes an income 125% over the poverty line. Your in a legal status right now and your TN status would remain in effect until a decision regarding your application is made. However, keep in mind that you must apply for Travel Authorization every time you want to leave the country until the decision is made. If you are approved, then your green card will be processed and you have no further need for the TN. If you are denied however, you will need to go back to your home country to requalify for another TN visa.
If she is an American citizen then you automatically get your visa converted over to an LPR application. Then the INS interviews you to make sure that it is not a sham marriage and then you are on you way to a green card. Good luck.
Your welcome.
