Help!! Previous Green Card holder...?

Here is the situation... I left the U.S. in 2003 to come back to my country. What was supposed to be a short term leave turned out to be longer. Anyway, I stayed in the U.S. for seven years as a GC holder (I even joined the us army)... This summer i plan to move back for good! What are my options if I want to come back legally (as I don't have a re-entry permit)? Thanks a lot.

Answer:
You don't have any options as far as your Green Card is concerned. After 1 year your immigrant status is considered to have been abandoned. You must start the immigration process all over again.

A lawyer cannot help and the embassy cannot do anything for you. It's the law.
Perhaps you might think of asking the US consulate or embassy in your area. I have an idea they might have a really good answer for you.
If your in the US Army and still active that will get you in. I would go talk to your CO.
You have, prima facie, lost your status. You should, of course, check with a reputable immigration attorney but, if you have lost your status, the only way to get back in is to be eligible under one of the categories to enter. If you have done it once, you can do it again. Do you have the same grounds to enter as you did in 1996? I do not know if one may apply for citizenship after having left the forces (I am assuming you have, otherwise this would not be an issue). Again, that is a question you will wish to ask an attorney.

At some point, it is likely someone from immigration will want to know why you abandoned your status. think about that and make sure you can explain it honestly whilst presenting your position in its best light.
You lost your right as a G. Card holder. You have to reapply & do the whole process again.
G.Card holders must not be absent from the US territory for more than a year, unless they have good reasons & proofs. Hospital reasons, etc.. If not your G. card becomes void .
You abandoned your residency.

Is the basis for your "Green Card" still in effect (ie are you still married to a US Citizen?).

Why didn't you get US Citizenship?

Stay in "your country."
