Will my baby have Russian AND US citizenship?

I'm a US citizen and my husband is Russian. Our baby is due to be born here in the states. What will his citizenship be? Will he have dual-citizenship?

While I'm at it, what about my husbadn? I know that my husband can apply for US citizenship since we are legally married. But, would that nullify his Russian citizenship? Can he be a dual-citizen?

Can I? Though we are living in the US, is it possible for me to get a Russian passport since I'm married to a Russian and will be the mother of a cutie 1/2 Russian rugrat? Whether we live in Russia or the States, can I get Russian citizenship without surrendering my US citizenship?

1. Baby will BeUS Citizzen by birth (Birth certificate SSN). In order to claim Russian Citizenship - Go to Russian Consulate and fill out papers - its a standard procedure. Baby will be Dual.

2. Husband can apply for GC, since you are married. Then he can apply for Am Citizenship. He will be dual as well. (both countries dont recognize dual citizenship officially, but a lot of people did it w/o complications).

3. You getting russian citisenship. Not possible. You will need to live in Russia, and denounce american. And its not worth it. In Russia its better to be American then russian, so dont worry. There is big (approx 10000) american (Like american, not russian-american) community in Moscow/russia and they feel just good the way they are.

The US doesn't recognize dual citizens, so you never want to give up US citizenship. But other countries do, so you can keep your US citizenship and get passports from other countries, if you qualify as a citizen in those countries. If Russia recognizes a baby born out of the country to a Russian father as a Russian citizen, you can get a Russian passport for the baby. Contact the Russian consulate.
I am not sure what the Russian laws are concerning citizenship. However, I do know that as a US citizen, no matter where your baby is born it will automatically have US citizenship. If you call the Russian embassy and/ or the US state department they will be able to answer your other questions. I hope this helps, and good luck!!

Since your baby is being born on American soil, yes, it will be a natural born US Citizen.
This can be seen in the case of mexicans, they have their babies up here, they are now US citizens, thus giving the parents some time to get their affaris in order and become citizens or atleast legal, themselves.

As for your husband, Russia is a very tricky country to be a dual citizen in. My good friend has a wife who is russian, he is from Wales. She cannot seem to be able to stay in wales longer then 3 months due to a citizenship error, even though she can become an EU citizen, she would have to give up her Russian citizenship. So though im no expert, I'd say its tricky at best for your husband.

For your child, your baby is an American, plain and simple, unless yourt husband has filed for a citizen abroad status from Russia, I doubt your baby will have any leway on becoming a russian citizen, then we go back to the duality problem.

There is Residency Visas and there are Applications for Immigration. And, as we speak the fees and regulations are changing. Used to be you had to declare total loyalty to the US Constitution to become American. That seems to have changed. Being born in the US, regardless of the parent's citizenship, makes the child American. A Russian husband married to an American woman does NOT automatically qualify him for citizenship and does require a Spouse Residency visa to keep living in the states.

I don't know for a fact, but I'd be willing to bet that to seek a Russian citizenship would void your American. Russian-status has special rules and laws from the 1950s attached.

(Been there and done all that ... better check with an attorney specialized in Immigration law just to save yourself some mistakes and paying fees twice).
You and your husband need to decide if you really want to stay here and raise your child as an American. It sounds to me as if you want the best of both worlds without having to commit to one country in particular.

Your husband can apply for American citizenship since you are American. As far as I know, he can't have dual citizenship. You either are one or the other in his case. The only cases I've known of dual citizenship are when a person is born to parents of one country who are stationed overseas or if there was a medical emergency (like with my sister's birth).
Also, I don't think an American citizen can get a Russian passport just because they're married to a Russian. You'd be better off getting one here (if you don't already have one).
