If yuowife is in Europe, and yuo are US Citizen, she is intending immigrant, and it is illegal for her to apply for non-immigrant visa (Anything else then GC).
H1B visa is dual intent, so that you can enter US on it and have immigration intent, but its also difficult to get and long and stuff.

I don't understand why you would need to file an I-130 appeal. If you are a US citizen, then your spouse qualifies for an immediate visa under I-130 sponsorship.
