Should my husband have to leave the country bc he came here illegally yrs ago,not by choice? bc His parents?

I am married to an illegal alien. We have been together 5 years and have 2 children. His parents came here illegaly years ago so it was not by choice and he grew up here. He works hard, takes care of his family, PAYS TAXES and does not get any "freebies". How is it that all of the people out there can judge someones situation. How about it being you? I may lose my husband to his home country because his family broke a law years ago. So shoud he be punished, shoudl my children be punished. We filed papers for him several years ago and still no answer.I can totally understand some of the positions out there. I do not think they should get free medical benefits, WIC, food stamps etc. I am an educated, professional woman trying to raise my family and I dont get anyhthing for free but that is our governments fault for allowing it all these years. I feel helpless in my situation. Please remeber this could be you. I can't help who I fell in love with.

First, illegal is illegal.. if he gets pickedup he may have to leave. However, it is my understanding that this is the type of situation that the Immigration amnesty program in the new bill is trying to address... so you should have hope.

Other tidbits: If you filed papers for his green card you should have heard something a long time ago -- they automatically send out a reciept and put it in for processing... that reciept has a number on it and you can look up the status on the Homeland Security Website. It is a long involved process but it usually takes no more than a year or two. The problem is that you may have "abandoned" the petition if you did not answer one or more of their inquiries. (Sometimes the INS put the wrong addresses on the outgoing mail so.. it is your responsiblity to check and track them)

There is an appeal procedure that could work if you abandoned the original petition so... if you did abandon the petition file again (with an attorney's assistance) and expect to be denied then appeal .. Sounds like extreme hardship to me...

BTW.. One of the other replys asked how is he paying taxes.. It seems that the IRS and the INS do not communicate on this issue so it is common that illegals pays taxes. There are many ways to get a social security number which is required to pay taxes. There are even ways to get the funds paid through a bogus SSN credited to a valid SSN account when someone get legal status. The IRS does not care if a person is illegal as long as they pay the taxes due the US government..
OK. My understanding is that if he is married to an American citizen he can stay here without a problem. Especially if the two of you have children. Consult an attorney.
This country has a lot more to offer than freebies, welfare and WIC. You're hearing this from a legal naturalized citizen. In my lowest beginnings I never received any kind of assistance from the government. It's your husband's parents fault, talk to them. You'll get no sympathy from me. Love him, love him like he was gone.
been there done that. My husband and I married and he got his green card and then his citizenship. I hear that Immigration is much stricter now,fines higher...and they are slower too. I think its ludicrous!! and i feel for you and your situation. Get legal help and see if there is anything you can do to at least postpone this until his papers come through. Good luck to you.
I don't think he's going anywhere... Even if u make him out to be this great guy or if he wasn't.
His continued presence is a crime. If you are a US Citizen and you are married, then he would be eligible for permanent status unless he has a criminal record. Your story does not seem valid. Especially, the "we filed papers several years ago and still no answer..."

Even if it was all true, is there any reason that you could not move to his home country if you really loved him?

How is he paying taxes if he is illegal?

Should a dope dealer get a free ride if he pays taxes on his drug sales? NO!

Taxes are "user fees" he derives benefits from his "taxes."

Your husband has every right to remain in this country. I truly feel for you and can empathize with your situation completely. Sometimes it seems as if the "land of opportunity" manages to punish people who want to work hard and build better lives as much as it advantages people who take citizen status for granted. I would continue to work on legalizing his status. If you're an American citizen and the two of you have children togetherr, it should be easier for him to get the proper papers without having to pay the price for a family member's mistake. I really hope this works out for you and your family. We can only hope that eventually, other Americans will realize that hardworking immigrants SHOULD be awarded (since they've earned it) legal status and be allowed to live their lives in this country with all the benefits of a permanent resident. This is the things that people all over the USA have to face every single day. Some people couldn't help coming in here illegally, but they still have to face the same consequences as people that did. Not only those this affect them, but also their friends and family. There are so many situations in which people should be legalized, instead of seeing them all as an individual person with a different situation, they are seen as a whole group of people that come here illegally. This is the type of mindset that most people have. People need to understand that not everybody has the same story.
