If a person overstays his student visa period in US what action can us govt take& how can the visa be extend?

Indian went to US for his master's degree, from Mails it appears that he is mentally disturbed & discontinued his studies, not giving his contact no. and address neither is he replying to the mails sent . His visa is going to expire by july 2007. How can we bring him back to India.

I used to have a F-1 visa so probably I can answer your question.

Well, F-1 students have to be full time students. They can't be part time unless they are teaching assistants or research assistants. And if they are graduate students, they need to take at least 3 or 4 courses to be full time per semester. But your son(?) seems that he's stopped going to class. That means the International Office has already contacted him why he hasn't been taking full courses.

If he has a reason to stop taking classes, he should've contacted the International Office and could've reduced the number of classes or could've taken a semester off legally by filing the document to the USCIS( the US Citizenship and Immigration Services). But if he hasn't contacted the International Office and hasn't filed any docoments to take a semester off or to reduce the number of classes, he will be considered as an illegal immigrant though he has a student visa stamped in his passport.

F-1 visa (student visa) doesn't mean anything if school kick students out. Since your son stopped taking classes, his school has sent him a letter to leave the country immediately. That means the expiration date of his I-20 doesn't mean anything and If he doesnt' have an I-20 that allows him to stay in the US, the visa is invalid though the visa is not expired.

Probably what I'm saying doesn't make sense. But I-20 is the most important thing for international students before F-1 visa. I-20 is sent by the school that they belong to and if the school doesn't allow them to stay in the school, that means they loose the right to stay in the country as a "F-1" student. And the visa wil be invalid. And if the students who are kicked out of school illegally stay in the US for more than 6 months, they will be deported and they can't reenter the US for 3 to 10 years.

And it seems that he is hiding somewhere in this country as an illegal immigrant. So he can be deported as soon as he is caught by immigration officers. And I don't think that he can extend his stay since he's alrady illegaly living in the US.

Well, The first thing that you need to do is to contact the International Office at the school your son belonged to. You can call, e-mail, or write a letter to the International Office and tell them that you haven't been able to find whereabouts of your son. I'm sure the International Office can tell you what you need to do for your son. So just contact the International Office.

Well, one of my friends did the same thing. She stopped contacting her parents after she failed many exams 5 years ago and she suddenly disappeared. And nobody really has known where she lives since then. So it's really hard for probably everybody to say you can find your son soon but at least as his parents, you must at least contact the Internatioanl Office and the Indian Embassy and Consulate. I'm sure they can give you some answers of what you need to do next.

He has to file a certain petition to extend his visa.
I think if he stopped going to class he is already in violation of his student visa. He can be deported, or worse, if they think he is up to something suspicious.
