IRS tax filing for a K-1 visa holder who has submitted i-130 & i-485 for Adjustment of Status.?
I don't know if she's considered a resident alien since she's waiting for her approval on i-485? Please help with genuine answers.
Answer:
Yes you can file joint (married). If she doesnt have a SS# yet apply for a ITIN at your local IRS office. She is considered a resident alien.
Speaking of Tax Filing. Google America: Freedom to Fascism. All the answers you'll ever need to know about how the Federal reserve is a fraud along with the IRS
I do not understand: is she in States? And you support her, and you are married? Why not, then?
Just in case ask again the IRS.
I assume that your wife entered the states by K-1 visa and she filed the petition for Adjustment of Status within the states. Anyway, if she is in the states, you can file a joint tax retun. I actually did with my husband even when I filed the petition for my AOS. Anyway, she is your wife, so I don't think there is a problem filing a joint tax return. Well at least I didn't have any problem with it.
