My grandpa just became a US Citizen. My Mom and I are both 'aliens' we've been in the US since I was 3 mo.
What I want to know is When my mom has her legal status here Canshe file something for me after I turn 21 or do we have to wait til shebecomes a US Citizen? Someone told me it'll take up to 10 yrs through my mom.true??? Ive looked in the USCIS.gov page but i don't get it UGH! Any sort of info will help.

You are in a very though situation.
1. If you are illegal, doesnt matter whethr you are here from age 3 month or what. You are accruing illegal presence after your 18th birthday. Illegal presence means you can have a ban to go to US for 10 years and subject to deprortation.
2.How is you mom getting her GC?, is it possible to go that way?.
3. Her sponsoring you will be extremely difficult and long, since you are in ilegal status now.
I guess you need to research section 245 a bit more, but I recall cases like yours to be pretty difficult.
point with the 'family member petition' is to bring people to United States of America legally. but your already here while once your grandpa file the petition for your mother he need to tell DHS: Department of Homeland Security where you mother is living and explain her Status in USA!!!
Your mom can get papers within 3 yrs maybe. When she is a citizen she can petition for unmarried children first. That can take several yrs also. Its is a long road. But don't take my info and everyone elses advice. Your best bet is get a lawyer specializing in Immigration. If you can't afford a lawyer the catholic social services are very helpful sometimes. Good luck. Ps Don't let others drag you down or let them upset you because of your legal statis. Your the largest minority and closing in on whites.
