If I as a foreginer give birth to an american citizens child in the US, can I and the baby stay in the USA?

if i'm in the country visiting my fiance while i'm pregnant with our baby and have the baby while visiting, can i and the baby stay in the usa? and will I as the mother of this american child be granted permanent residency?

Answer:
No, you and the baby get sent back to your country of origin and you can apply for visas from there. You may have your request expedited because of the baby, but you still have to go back. There was a story on CNN just recently about this very issue.
the baby is then US citizen. u'd have to consult an attny about the mother. I think the mother would have to be treated as a regular visitor and return to her country of origin with her child on a US passport and visa if necessary. The mother may be granted special status and have her stay extended if the baby cant travel but thats about it .

No. The baby is a citizen but you are not. You would have to go back to your country and apply for citizenship.

U will be able to stay in the US and your baby will be an american citizen so they can't make the baby leave and if u take the us citizens test and pass u can stay. hope this helps

You need to call Immigration and ask for sure but as far as I know the child is automatically an American citizen and you will be able to stay but you still must apply for citizenship the same as everyone else.
A baby born in the US is automatically a US citizen. For you, however, it's a different story. A lot of paperwork and all that good stuff, but a having a chid in the US does not mean you can automatically stay.

why not take your baby and go home, where you belong? or go to holland, they have much better welfare and social services for you to sponge off of.
If you enter the US as a visitor, you can't stay in the US. You need to enter the US by using a fiance visa, then you can " live" in the US. But your child can stay in the US with your fiance since the child is his kid and the child has a right to get a citizenship here in the US. But unfortunately, you can't stay.

If you want to stay in the US, enter the US by an appropriate visa. And if you enter the US by visa waiver and stay here, you will be considered as an illegal immigrant.
i think its better for you and your child to go back to your country because being born in USA and given the nationality that its a must for the child to stay in USA
