I got a visiting visa here in US, but i overstayed it. i found a employer who wants to petiton me.can she help

me or petition me? if ever how long does it takes? thanks

Answer:
You cannot change your status if you are already in the country illegally. If you are offered a job and the employer wants to apply for an H1B, then you will need to leave the US, and wait for the visa to come through before you can go back. And this process is likely to take a year or more (there's a big backlog).

By the way, you cannot get a green card by virtue of employment. You can only get a temporary residency visa, which is for a maximum of 3 years. You have to have a home (even if it is your parents home) and job to go back to in your home country at the end of the visa, otherwise the temptation might be too great for you to overstay your visa - AGAIN.
You've already shown you will break the law. Perhaps you need to be sent back and have to come back the proper way.
If she is willing to sponsor you and file for a green card for you you can stay but make sure she does the legal paperwork for you.
I would recommend you contact an immigration lawyer to get the big picture and the steps, it can be done but you may have to go back to the country of origin for interview with us consulate, you should also try the green card lottery (its free, no need for a lawyer but next one is in october) check out the website below
you should go back to your country of origin and reapply for a visa properly. Breaking one American LAW is just as bad as breaking all the American LAWS.
once you have been invited to come to a country for a certain amount of time , whatever you visa said ? and you overstayed ? you have broken the law................otherwise ? why do you think they let you come for a certain amount of time of give you a visa ? you did not take their invitation seriously ?not to overstay ? .................................
good luck
Only if what are you going to do in that position can not be performed by a legal alien or American citizen they could file to benefit you. Otherwise sorry but you can't go through that process
well I have friends that their job sponsor them but they did it when they were in Canada...I think that even if she can help she might have to pay a big fine and it will show that she hired ilegal inmigrants so I don't think that is a good idea. If I was the INS I will have to put her in jail or give her a big fine because of hiring an Illegal is an example...She will be lucky if she doesn't get in any trouble...Unless you are not working for her right now...Then I gues she can sponsor you and you maybe get a work permise...But all this process it have to be done when the Visa haven't expired... Ofcourse that she have an stability in her company etc...
