F-1 student visa status issue I am getting suspended from school and can come back ..do I need new 1-20?
is it okey if i just don't go to other school for new I-20 and wait until they issue me with new I-20 for fall in august? I know its probably not recommended but how would they find out? would I be in big trouble?
thanks..
Answer:
Your school may or may not find out, but thats not the main point. If you plan to apply for a work visa or a green card in the future, you don't want to have ANY status violations on your record.
I am F-1 student visa too, but I don't know the answer to your question, but my suggestion is to talk to lawyer about this.
If you don't go to another school, you will be out of status and may end up being deported. If you don't want to do that, then go back home temporarily for a few months or get a 4 or 5 month visitors visa to Canada.
They will know you didn't attend school. This is because of the SEVIS system. All college and university International Student Advisors are supposed to turn in lists of all foreign students in the institutions, including the number of academic credit or course hours they are taking each semester. After the semester begins, the International Student Advisors have to turn this info in to BCIS within by the 3rd week after the semester begins.
The BCIS knows the universities and colleges each F1 student is attending/or is supposed to attend. If no record of your academic credit hours is received by BCIS or if you've taken less than full time hours, whenever F1 student attendance records are sent in to BCIS, they put you in a list of students that are violating F1 visa status. You then become out of status and this information is sent to I.C.E(Immigration and Customs Enforcement) agency.
ICE officers then track you down based on your listed addresses via your Driver's Licenses, address records, residential address records and any other info in the government's database. ONce the ICE catch you, you get detained in jail or immigration detention center until they find the next available flight to your homeland; they also contact your country's emabassy or consulate to let them know you are being deported. The flight bill goes to your country's embassy.
This will make you barred from ever returning to the USA for 3 or up to 10 years depending on how long you have been out of status.
you do but you wont get one.
