Conversion of Part-time H4 visa student to F1....Urgent plz help?
I got offer for part-time MBA in College Park,Maryland though I applied for a full-time course.I am in H4 visa status now.I am in a dilemma whether to join as its a very good college ....but I have doubts regarding my change of status to work visa later on after my education....In the last semester of my course,can I change my visa status to F1 so that it would be easier for me to convert to H1 later on.
As conversion of H4 to H1 is a very time-taking process.....Plz help......Need ur valuable advices......

It is not easier converting to H1 from F1 than it is from H4, but time you spend in F status does not count as time in H status. You get only 6 years in the US in an H status, so if you can pass time in F status, you will have more time available to you in H1 status later. You can also take OPT for up to 1 year once you finish your studies to give you a cushion for getting into H1 status.
IMO, best course is to go into F1 status ASAP and save your H time for after you graduate. During last semester of school, apply for an EAD (you get it through school under OPT). Line up an H1 sponsor as early as possible, the quota opens up April 1 each year for employment to commence October 1 that same year. OPT will let you work until the H1 takes effect October 1, if you time it right. Best timing is to finish your degree in the fall and take OPT from grad date for 1 year, say 12/20/08 - 12/20/09, and apply for H1 on 4/1/09 to take effect 10/1/09.
Final note: you also need to coordinate your travel plans/visa needs with any green card process your spouse might be undertaking. If you have an I-485 pending, you might not be able to get F1 status because at that time you are an intending immigrant and F1 is exclusively a nonimmigrant status. H1 and H4 are both dual intent, so adjusting status to PR is easier from H status than F status.
You need to be on F1 for a period of one year to be eligible for OPT. One way will be to start your studies on H4 and convert to F1 at the begining of third semester. Being on H4 may make you eligible for in-state tuition (if UMCP does have an in-state and out-of-state tuition system).
There is no particular advantage in converting from F1 to H1 (as opposed to H4 to H1), both are equally easy.
