This is happening. However, you could be charged for kidnapping, unlawful detention and many other things. While a person's political views might conceptually support such an action, it is illegal on its face. The fact that the act is being perpetrated on a non-citizen does not make it legal.

How about jailing the people who hire illegals.
Let's start there first. Then we wouldn't need a fence. They would have no reason to come.

Though I would be concerned for our citizens' safety once the illegals discover they've been had. There are many, many violent criminals who regularly cross the border.
I would really, really like to see our border partol and national guardsmen be allowed to really enforce our border, though... In the eyes of the world we've become pansies who are too concerned about what other nations might think of our handling of domestic issues, though. Sigh.

If all illegal aliens depart or are deported, all legal immigration halted, and all temporary employment visas abolished, we still have a problem with more US-born workforce entrants than new jobs created. Illegal immigration damages our country and our citizens every day at every level. And not even the attacks of 2/26 and 9/11 have awakened many Americans to the vast dangers illegal immigration poses to our selves, our families, our communities, our society, our values, our principles, our civilization. I think its retarded and I totally agree with a previous poster who mentioned how can you tell if someone is illegal or not and what credentials they have for viewing documents!
