UK Ancestry Visa and bankruptcy?
Thanks
Answer:
The the British embassy in Australia states that you need to met certain requirements two being:
you are able to work and intend to do so in the UK
you can support yourself and any dependants, and live without needing any help from public funds
I think that if you declare yourself bankrupt you won't be able to support yourself when you land in Britian and as a result you may be denied an visa.
Give the embassy a call if you want.. just a reminder.. have your credit card ready because they charge you $7 for the phone call (they bill you via the credit card).
Your debt needs to be cleared up before you go in one way or another. You need to prove to the Brits that you won't be a burden on their society. If you cannot afford a payment plan on your debts and have no UK job prospects, you will be seen as a potential welfare user and will be denied.
If you declare bankruptcy in Australia, but have money saved (i think there is a UK visa website that gives a chart on the amount needed) then you are in better shape, but it may still effect your visa. Their reasoning may be, "if they can't stay afloat there, can they stay afloat here?" Have a response to that question ready.
A good example is my own situation. I'm not declaring bankruptcy. I'm coming from the US to the UK. I have little savings (enough to pay off my debts gradually), but I have 2 job offers for if I am approved. The fact that I have jobs lined up that will keep me financially comfortable helps my application. It shows that I am desired by employers and will add not detract from their society.
I also agree with some of what is said by your other answerers. Get a lawyer if you can afford one. And if there is anyway you can NOT declare bankruptcy, you are in a better position. As long as you can prove a continued effort to pay off the debts (you're not running away) and continue to support yourself (you don't go hungry and homeless), a debt is not as bad as a bankruptcy. Check with your local embassy, or check their website (they usually have the answers to your questions for free on their site. found most of my info there)
